1. General Provisions

These Terms of Use govern the rules for accessing and using the website www.teslift.rs (hereinafter: the “Website”), the rights and obligations of Website users, as well as other matters relevant to the use of content and functionalities available through the Website.

By accessing the Website, browsing it, registering a user account or using any of its functionalities, the user confirms that they are familiar with these Terms of Use and accept them.

If the user does not accept these Terms of Use, they must cease using the Website.

2. Purpose and Intended Use of the Website

The Website is intended to present TESLIFT products and services, in particular material-handling and internal-transport equipment, including forklifts, pallet trucks, stackers, warehouse equipment, spare parts, service services and other related products and services.

Through the Website, users may be provided with:

an overview of products and their features;
an overview of information about services;
registration and use of a user account;
submission of inquiries;
requests for offers;
contact with the TESLIFT team;
access to other functionalities made available by the Company.

The content of the Website is primarily informational, except where it is expressly stated that the use of a particular functionality produces a specific legal effect.

3. Information About Products and Services

TESLIFT endeavours to ensure that descriptions, photographs, technical data and other information about products and services published on the Website are accurate, complete and up to date.

However, due to changes in manufacturers’ specifications, supplier programmes, product availability or other circumstances, certain product features may differ from the data or photographs published on the Website.

Product photographs may be illustrative, unless expressly stated otherwise.

Information on load capacity, dimensions, lifting height, battery capacity, spare-part compatibility and other technical characteristics must be interpreted in accordance with the technical documentation for the specific product.

Where a particular feature is decisive for the selection of equipment, users are advised to verify it with the TESLIFT team before purchase or contracting.

4. Selection and Intended Use of Equipment

The selection of an appropriate forklift, pallet truck, stacker, spare part or other equipment depends on the specific conditions of use, including, among other things:

the weight and type of load;
the dimensions and type of pallet;
the required lifting height;
the type and condition of the surface;
aisle width and available manoeuvring space;
the slope of the working surface;
the intensity and mode of operation;
working-environment conditions.

The information available on the Website does not replace an assessment of the specific working conditions where such an assessment is necessary for the proper and safe selection of equipment.

The user is required to use the product exclusively in accordance with its intended purpose, declared technical characteristics, the manufacturer’s instructions, professional standards and regulations relating to occupational safety and health.

TESLIFT shall not be liable for the consequences of using a product contrary to its intended purpose, the manufacturer’s instructions or declared limitations, except in cases where liability cannot be excluded or limited under applicable regulations.

5. User Account

Creation of a user account may be required to use certain functionalities of the Website.

During registration, the user is required to enter accurate, complete and up-to-date information.

The user is responsible for maintaining the confidentiality of their username, password and other information that enables access to their account.

The user must not allow an unauthorised person to use their account.

If there is any suspicion of unauthorised access to the account or compromise of login credentials, the user should change the password without delay and notify TESLIFT.

TESLIFT has the right to temporarily restrict or disable the use of an account if there are justified reasons to suspect:

unauthorised use;
an attempt to compromise the security of the Website;
misuse of functionalities;
provision of manifestly incorrect information;
conduct contrary to applicable regulations or these Terms of Use.

6. Inquiries, Offers and Conclusion of Contracts

Sending an inquiry, requesting information, registering an account or using another form of communication through the Website does not, in itself, constitute the conclusion of a contract, unless expressly stated otherwise for a particular functionality.

When a user requests an individual offer, the contractual relationship is established in accordance with the content of the specific offer, its acceptance and other terms agreed between the contracting parties.

If TESLIFT enables the direct conclusion of contracts or purchases through the Website, such purchases will be subject to separate terms of sale or purchase, together with all mandatory regulations applicable to the specific legal relationship.

Where the buyer qualifies as a consumer within the meaning of the applicable regulations of the Republic of Serbia, no provision of these Terms may be interpreted in a manner that would exclude or limit the rights granted to the consumer under mandatory regulations.

7. Intellectual Property Rights

The content of the Website, including in particular:

the TESLIFT name and marks;
logos;
texts;
photographs;
graphic solutions;
illustrations;
design elements;
databases;
the layout and structure of the content;
technical elements of the Website;

is protected by regulations governing copyright, trademarks and other intellectual property rights, to the extent that it meets the conditions for such protection.

The user is permitted to view and use the content of the Website for their own informational purposes.

Without the prior written consent of the rights holder, unauthorised copying, reproduction, modification, publication, distribution, sale, licensing, commercial exploitation or other use of protected content is not permitted.

8. Prohibited Use of the Website

circumstances that objectively could not have been foreseen, prevented or remedied.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited in advance under mandatory regulations.

In particular, where the user qualifies as a consumer, the provisions of these Terms do not affect the rights granted to the user under consumer-protection regulations.

The inclusion of such a link does not mean that TESLIFT controls, approves or guarantees the content, security or business practices of the third-party website.

The use of third-party websites is subject to the rules established by their owner or operator.

The parties will endeavour to resolve any disputes amicably.

If an amicable solution is not possible, the court with jurisdiction under the applicable regulations of the Republic of Serbia shall be competent to resolve the dispute.

Where the user qualifies as a consumer, this provision may not be interpreted in a manner that denies the consumer the right to judicial or other protection granted under mandatory regulations.
